FERC Denies Rehearing of Order No. 822

On July 21, 2016, in Docket No. RM15-14, FERC issued Order No. 822-A denying requests for rehearing of Order No. 822, which was issued on January 21, 2016. Order No. 822 approved of NERC’s proposed alternative to the directive in Order No. 791 that NERC develop a definition of “communication networks.”  Foundation for Resilient Societies and Isologic filed requests for rehearing claiming that the decision to approve NERC’s alternative approach, which does not include substations in within the definition of “communications networks,” was in error. In response, FERC denied the requests and upheld its decision in Order 822.
