Balch Attorneys Presented at Alabama Construction Law Summit on Negotiating Contract Terms and Key Construction Law Issues

Attorneys from Balch’s Construction and Litigation Practices spoke at the sixth annual Alabama Construction Law Summit presented by the Construction Law Section of the Alabama State Bar. The summit, held on December 5, 2019, in Birmingham, AL, covered relevant topics impacting the construction industry. Attendees had the opportunity to learn more about false construction claims, negotiating terms of contracts, environmental issues and codes of ethics. 

Chuck Burkhart, partner in the firm’s Litigation Practice, presented “Negotiating Important Construction Contract Terms: A Mock Negotiation Featuring Counsel for the Owner, Contractor, and Architect.” Chuck has developed a national construction practice representing owners, architects, general contractors, and subcontractors on claims ranging from mechanics liens, drafting and negotiation of high-value construction contracts, to the litigation and trial of complex construction disputes.

Josh Bell, partner in the firm’s Construction Practice, and Joe Leavens, partner in the firm’s Litigation Practice, discussed “Multi-State Survey and Comparison of Key Construction Law Issues” at the Summit.

Josh is skilled at leading critical and complex negotiations and drafting a wide array of contracts, including design and construction agreements, Engineering Procurement and Construction (EPC) contracts, Power Purchase Agreements (PPAs), purchase and sale agreements, equipment and services supply contracts, operation and maintenance (O&M) agreements and performance guarantee agreements.

Joe has a diverse practice focusing on joint use and pole attachment issues for utilities across the United States; products liability defense for national manufacturing companies; construction disputes for owners, general contractors and subcontractors; and insurance coverage analysis for both insurers and insureds.
