David Bowsher and Jonathan Hoffmann Speak at ACA International Fall Forum

David Bowsher and Jonathan Hoffmann, partners in the firm’s Birmingham office, presented at the Fall Forum, presented by The Association of Credit and Collection Professionals on November 6-8 in Chicago, Illinois. 

ACA leads the accounts receivable management industry through education, advocacy, and resources designed to help members succeed. ACA’s Fall Forum focused on business efficiencies, productivity, and building strategies and solutions to reduce costs and maximize value.

David and Jonathan’s session was titled, “M&A Reno: Prepping for Deals & Turning Around Troubled Ones.”

Their presentation focused on how to structure deals to ensure businesses achieve their objectives, as well as all of the strategic and tactical levers available to adapt to the inevitable mystery facts that arise during due diligence. Participants explored how creativity and adaptability can strengthen their deals, along with how flexibility and resourceful lawyering may create more effective solutions.

David is a partner in Balch’s Mergers & Acquisitions and Creditors Rights & Bankruptcy Practices. advises on mergers and acquisitions, bankruptcy matters, and oil and gas acquisitions and financing. The focus of his mergers and acquisitions practice is middle market deals, in which he has represented both buyers and sellers. David has deep background in all aspects of corporate restructuring, with particular experience in §363 asset sales in bankruptcy cases. Additionally, David's extensive corporate and transactional experience includes securities offerings, financing transactions and capital raising efforts for companies of all sizes, from start-ups and emerging growth companies to more established businesses.

Jonathan is a partner in Balch’s Consumer Finance Compliance & Defense Practice. He has handled hundreds of individual and class action lawsuits under the Telephone Consumer Protection Act (TCPA), Fair Debt Collection Practices Act (FDCPA), and the Fair Credit Reporting Act (FCRA), advising clients on compliance with these statutes and their regulations, as well as Unfair, Deceptive, or Abusive Acts or Practices (UDAAPs). Jonathan’s litigation practice also extends to representing clients in  bankruptcy litigation, workouts, and collection actions. He regularly defends clients in arbitrations before the Financial Industry Regulatory Authority (FINRA), representing both broker-dealers and registered investment advisors.
