About Jim
Jim is a respected leader in the hydro industry, serving for many years as a board member and general counsel of the National Hydropower Association. He has testified before Congress on hydro legislation and chaired several bar association hydro committees.

  • What types of clients do you represent?

    As a hydropower lawyer, I represent licensees and other entities who have an interest in any issue related to a hydroelectric project. Though many of these issues can involve licensing proceedings before FERC, they also include other issues such as environmental compliance, water supply, water and riparian rights, and flood control. While FERC licensees tend to have the most legal needs associated with these issues, anyone who has an interest in water can need legal support in order to protect their rights and take advantage of opportunities. I also work with clients with respect to federal political law issues such as Lobbying Disclosure Act compliance and federal campaign finance law.

  • Hydro licensing proceeding: Provided legal counsel and strategy advice to a hydro licensee during a twelve-year relicensing proceeding that involved multiple rehearing requests at FERC and a petition for review to the D.C. Circuit Court of Appeals. (2001 - 2013)
  • Hydro licensing proceeding: Provided legal counsel and strategy advice to a hydro licensee in the relicensing of a 960 MW multi-development project that required a successful rehearing request by the licensee to amend several license articles. (2001 - 2016)
  • Hydro licensing proceeding: Provided legal counsel and strategy advice to a hydro licensee in the relicensing of a 180 MW project with a 40,000 acre reservoir and over 700 miles of shoreline. (2005 - 2015)
  • Hydro operations litigation: Represented a client in the defense of a lawsuit alleging that the operation of a hydro dam caused significant financial damage to the plaintiffs and demanding the construction of cooling towers at a downstream coal-fired plant in an attempt to modify the operations of the hydro dam.  This effort resulted in a summary judgment order in favor of the client, which was upheld by the 11th Circuit. (2011 - 2014
  • Water withdrawal from reservoirs: Worked with a hydro licensee to develop a program for permitting water withdrawals from a FERC-licensed reservoir, which included a methodology for calculating the amount of compensation to be paid the licensee for the impacts caused by the withdrawal. (2011 - 2016)
  • Campaign finance: Provided legal advice and counsel to a large construction company with respect to the establishment of a federal political action committee (PAC). (2013 - 2014)
  • Hydro legislation: Provided legal advice and counsel to an electric utility client with respect to federal energy legislation that provides efficiencies in the federal licensing process of hydro projects, including process improvements for the licensing of certain pumped storage projects. (2013 - 2016)
